Marketplace Buyer Terms

The terms on which you buy products from vendors in the Visit Gauteng

About these terms

These terms govern purchases of products in the Visit Gauteng Marketplace. They apply with our Terms of Service, Privacy Policy, Returns/Refunds/Defects Policy and Shipping & Delivery Policy. By placing an order you agree to them.

Who you are buying from

The Marketplace is operated by Mind Interactive Holdings (Pty) Ltd (trading as Mind Interactive) under the Visit Gauteng brand, and connects you with independent vendors. Your contract of sale for the goods is with the vendor who lists the product. Mind Interactive operates the Marketplace and is the merchant of record for payment; the vendor is the seller and is responsible for the product and its fulfilment. Mind Interactive is the principal for value-added tax on marketplace sales and accounts for VAT on those sales; prices shown include VAT where applicable.

Product information and pricing

  • Listings disclose, per section 43 of the ECT Act, the seller, the total price including VAT and delivery, and the product details.

    • Prices are in Rand. Delivery cost is shown before you pay.

    • Vendors are responsible for the accuracy of their listings; report an inaccurate listing using the report control.

Placing an order

Your order is an offer to buy. A contract forms when the vendor accepts/confirms or dispatches the product. Payment is processed by PayFast; we do not store card details. You will receive an order confirmation in your account and by email.

Delivery

Delivery is handled by the vendor and/or a third-party courier under our Shipping & Delivery Policy. Risk in the goods passes to you on delivery. Where no delivery time is agreed, dispatch is within the default period in that policy (and within 30 days as a longstop under section 46 of the ECT Act).

Returns, refunds and faulty goods

Your rights to return goods, the 7-day cooling-off right and its exceptions, and your remedies for defective goods (Consumer Protection Act sections 55-56) are set out in the Returns, Refunds & Defects Policy.

Prohibited items

Vendors may not list, and you may not order, items prohibited by our Prohibited & Restricted Items Policy. Report any listing that appears to breach it.

Disputes

Contact the vendor first. If unresolved, email [email protected] and we will mediate in good faith. This does not limit your Consumer Protection Act rights.

Liability

The vendor is responsible for the product. To the maximum extent permitted by law, the GTA's liability is limited as set out in the Terms of Service; nothing excludes liability that cannot lawfully be excluded under the CPA, including product-liability rights.
