Terms of Service

These terms govern your use of the Visit Gauteng platform. By creating an account or using the app you agree to them. If you do not agree, please do not use the service.

The service

Visit Gauteng is operated by the Gauteng Tourism Authority (GTA) with technical platform services provided by Mind Interactive (Pty) Ltd. The service includes the Visit, GCCEB, Live, Marketplace and More sections, accessible at visit.gauteng.net.

Your account

  • You must be at least 16 years old to create an account.
  • You are responsible for keeping your password secure and for activity on your account.
  • Provide accurate information. We may suspend accounts with deliberately false information.
  • One account per person. Vendor accounts represent the business they are registered to.

Acceptable use

You agree not to:

  • Use the service for any unlawful purpose or in violation of South African law.
  • Post abusive, defamatory, discriminatory, or sexually explicit content.
  • Impersonate any person or misrepresent your affiliation with any organisation.
  • Interfere with the platform: scraping at scale, denial of service, exploiting bugs.
  • Resell access to the service or bulk-export listings for competing services.

We may suspend or terminate accounts that breach these rules, with or without notice depending on severity.

Bookings and orders

When you book an experience or place an order, you enter into a contract with the vendor who operates that listing, not with the GTA. The GTA provides the platform and handles payment, but the vendor is responsible for delivering the service or product.

  • Payment: processed by PayFast. Charges appear on your statement under the vendor name or "Visit Gauteng".
  • Cancellation and refunds: follow the vendor's stated policy on the listing page. Contact the vendor first; we mediate if needed.
  • Disputes: email [email protected] within 7 days of the booking or order.

Vendor terms

If you list as a vendor, additional terms apply:

  • You warrant you have the right to sell the products or services listed.
  • You must honour bookings and orders accepted through the platform.
  • Platform commission is deducted from payouts; the rate is shown in your vendor dashboard.
  • Payouts are made to the bank details on file. You are responsible for keeping these current.

Content you post

You retain ownership of photos, reviews, posts and other content you contribute. By posting, you grant the GTA a worldwide, non-exclusive, royalty-free licence to display, distribute and adapt that content within the Visit Gauteng platform and in associated marketing of the platform.

We may remove content that violates these terms, infringes a third party's rights, or harms the platform.

Intellectual property

The Visit Gauteng brand, app, design, and software are owned by the GTA and Mind Interactive respectively. You may not copy, modify or redistribute substantial parts of the platform without written permission.

Disclaimers

The platform is provided as is. We do our best to keep it accurate and available, but we do not warrant that listings are error-free, that the service will be uninterrupted, or that any particular booking will be available. Vendor information is provided by the vendor and may change.

Outdoor and adventure activities carry inherent risk. You accept that risk and the vendor's own conditions of participation.

Limitation of liability

To the maximum extent permitted by South African law, the GTA's total liability to you for any claim arising out of the platform is limited to the total amount you paid through the platform in the 12 months preceding the claim. We are not liable for indirect, consequential or punitive damages.

Changes to these terms

We may update these terms from time to time. The effective date at the top reflects the current version. Material changes will be notified in the app or by email. Your continued use of the service after a change means you accept the updated terms.

Governing law

These terms are governed by the laws of the Republic of South Africa. Any dispute that cannot be resolved by good-faith negotiation will be referred to the courts of Johannesburg, Gauteng.
